Litigation, mediation, and arbitration

Litigation, mediation, and arbitration

Our professional practice covers all phases of a legal dispute. We prioritise negotiation, the pursuit of amicable solutions, and intervention in alternative dispute resolution (ADR) mechanisms such as conciliation and mediation. When these avenues are insufficient, we represent our clients in proceedings before ordinary courts or, where appropriate, before arbitral tribunals.

Our litigation department is responsible for representing our clients in court. We understand that from the moment they decide to file a claim or are served with a notice, their normal activities are disrupted. That is why we have developed protocols based on years of experience, designed to minimise the impact of legal proceedings on their day-to-day lives and to provide detailed, understandable information.

We act in all types of judicial proceedings at all court levels, both national and within the European Union, and, when necessary, before the Constitutional Court. If you have received a court notification and require expert advice to protect your rights, we invite you to contact us through our contact form. Attaching a copy of the document you received will allow us to provide a faster and more accurate initial assessment.

We recognise that litigation is not always the most suitable solution. Therefore, we actively promote mediation as an effective method for resolving disputes. This procedure, based on its voluntary and confidential nature, allows for satisfactory and lasting agreements with the assistance of a mediator. Our team advises and supports the client throughout the entire process, ensuring their interests are defended and that the agreement is legally sound and enforceable. Our civil procedure law now requires the use of so-called ‘Adequate Dispute Resolution Methods’ (MASC in Spanish) as a procedural prerequisite, making our experience in this field an invaluable tool.

Arbitration serves as an alternative to the ordinary courts, where the parties submit their dispute to the decision of one or more arbitrators. This method culminates in an award that has the same binding effect as a final court judgment. Our work ranges from drafting solid and effective arbitration agreements to providing comprehensive legal representation in arbitration proceedings, whether institutional—before any national or international court of arbitration—or ad hoc.
